1. Who We Are

Phenom Mod (“Phenom Mod,” “we,” “us” or “our”) runs the online store at store.phenommod.com (the “Site”). We are based in the United States and ship to US and international addresses.

This Privacy Policy explains what personal information we collect when you visit the Site, create an account or place an order, how we use it, who we share it with, and the choices you have. It applies only to the Site, not to other websites or services we link to, such as our Discord server.

2. Information We Collect

Information you give us. When you place an order, create an account or contact us, we collect:

  • your name, email address and phone number;
  • your billing and shipping addresses;
  • your account username and password (passwords are stored encrypted);
  • the products you buy, order totals and order history;
  • anything you include in messages to us, such as return requests or photos of a defective item.

Information collected automatically. When you use the Site, we and our service providers automatically collect:

  • your IP address;
  • your browser type, device type and operating system;
  • pages you view and what you add to your cart;
  • information stored in cookies (see Section 5).

Information from others. Our payment processors tell us whether a payment succeeded and may give us limited details such as the card type and last four digits. We never see or store your full card number. Shipping carriers give us tracking and delivery updates, including when a package is returned to us.

 

3. How We Use Your Information

We use your information to run the store and fulfill your orders, including to:

  • process payments, ship orders and send order confirmations and tracking updates;
  • prepare customs declarations for international shipments;
  • handle returns, refunds, warranty claims and customer service;
  • manage your account;
  • prevent fraud and abuse, including blocking orders from people who have committed fraud or abused our store;
  • comply with tax, accounting and other legal requirements.

Record of your agreement to our Terms. When you place an order, we save the date and time, your IP address and the version of our Terms and Conditions in effect. We keep this with your order as a record of what you agreed to, and may share it with a payment provider or bank if an order is disputed.

Marketing emails. We only send news about products or restocks if you have signed up for them or the law otherwise allows it. Every marketing email includes a way to unsubscribe. Order and shipping emails are not marketing, so you will still receive them.

We do not sell your personal information, and we do not use it to show you targeted advertising.

 

4. Who We Share Information With

We share personal information only as needed to run the store:

  • Payment processing: our payment processor, ZenPayments, and our payment gateway, Authorize.net, receive your payment details to process your order. They handle your card information under their own privacy policies.
  • Shipping carriers and postal services receive your name, shipping address, phone number and package details to deliver your order.
  • Customs authorities in the destination country receive the details on the customs declaration for international orders, usually your name, address, phone number and the contents and value of the package. They may also contact you about import duties and taxes.
  • Service providers that host and run the Site, such as our web host, security and performance services like Cloudflare, and email delivery services. They may only use your information to provide their services to us.
  • Payment providers and banks during a dispute. If you file a chargeback or payment dispute, we may share your order details, tracking, communications and the record of your agreement to our Terms.
  • Legal authorities when required by law, or when needed to protect our rights, prevent fraud or respond to a legal claim.
  • A new owner if Phenom Mod is sold, merged or reorganized. Your information would stay covered by this policy or one at least as protective.

We do not sell or rent your personal information to anyone.

 

5. Cookies

The Site uses cookies, small files stored in your browser, mainly so your cart, login and checkout work. We do not use advertising cookies.

The cart, login and security cookies are necessary for the store to work. You can block or delete cookies in your browser settings, but the cart and checkout may not work without them.

 

6. How Long We Keep It and How We Protect It

Retention. We keep personal information only as long as we need it:

  • Orders, including the record of your agreement to our Terms, for as long as needed for tax and accounting rules, returns, warranty claims and payment disputes.
  • Accounts until you ask us to delete yours.
  • Messages for as long as needed to resolve your request.
  • Fraud and abuse records for as long as needed to protect the store.

Security. The Site uses encrypted HTTPS connections. Access to customer information is limited to people who need it to fulfill orders and provide support. Card payments are handled by our payment processors, not stored on our servers. No website can guarantee complete security, but we take reasonable steps to protect your information.

 

7. Your Rights and Choices

For all customers. You can ask us to:

  • give you a copy of the personal information we hold about you;
  • correct information that is wrong;
  • delete your information or your account;
  • stop sending you marketing emails (or use the unsubscribe link in any marketing email).

To make a request, email [email protected] from the address on your account or order. We may ask for details to confirm it is you, and we will respond within 30 days. Some information, such as order records, we must keep for tax, legal or dispute reasons even if you ask us to delete it. If we turn down a request, we will explain why, and you can reply to ask us to reconsider.

Customers in the EU and UK. We process your information on these legal bases:

  • Contract: to take payment, ship your order and handle returns.
  • Legal obligation: to meet tax, accounting and customs requirements.
  • Legitimate interests: to prevent fraud, keep the Site secure, keep records for payment disputes and understand how people find the Site.
  • Consent: for marketing emails where the law requires it. You can withdraw consent at any time.

You also have the right to restrict or object to our processing, and to receive your information in a portable format. You can complain to your local data protection authority, such as the ICO in the UK.

US state residents. Depending on where you live, state law may give you rights to know, correct and delete your personal information. You can use them as described above. We do not sell your personal information or share it for targeted advertising, and we will not treat you differently for using your rights.

 

8. Other Terms and Contact

International customers. We are based in the United States, and your information is processed and stored there. If you order from outside the US, your information is transferred to the US so we can fulfill your order, and shared with carriers and customs in your country to deliver it.

Children. The Site is not directed at children under 13, and we do not knowingly collect their personal information. Orders must be placed by adults, as our Terms and Conditions explain. If you believe a child has given us personal information, contact us and we will delete it.

Other websites. The Site links to other sites, such as our Discord server and carrier tracking pages. Their own privacy policies apply there, not this one.

Changes to this policy. We may update this policy from time to time. The “Last updated” date below shows when it last changed. If we make a significant change, we will post a notice on the Site.
