1. Overview and Acceptance
By placing an order or using store.phenommod.com (the “Site”), you agree to these Terms and Conditions (the “Terms”). If you do not agree, please do not use the Site or place an order.
The Site is operated by Phenom Mod (“Phenom Mod,” “we,” “us,” or “our”). “You” and “customer” mean anyone who browses the Site or buys from us.
These Terms apply together with our Returns Policy and Privacy Policy. Where they conflict on shipping, duties or refunds, these Terms control.
2. Eligibility and Accounts
You must be at least 18, or the age of majority where you live, to place an order. If you are younger, a parent or guardian must place the order and accept these Terms.
If you create an account, you are responsible for keeping your login details secure and for all activity under your account. The information you give us, including your name, email, phone number and shipping address, must be accurate, current and complete.
We may refuse service, cancel orders or close accounts at our discretion, including for suspected fraud, abuse or breach of these Terms.
3. Products, Modifications and Warranty
Product information. We try to describe and photograph products accurately. Colors, board revisions and packaging may vary slightly from images. If a product is not as described, your remedy is to contact us under Section 7.
Backorders and pre-orders. Items marked “Backorder” or “Pre-order” are not in stock. Estimated ship dates are estimates only and may change due to manufacturing or supplier delays. You may cancel a backordered or pre-ordered item for a full refund at any time before it ships.
Modding risk. Our products are intended for modifying game consoles and related hardware. Installing them may require soldering and technical skill. Modding may:
- void your console manufacturer’s warranty;
- permanently damage (“brick”) your console or other hardware if installed incorrectly;
- result in your console or account being banned from online services.
You accept these risks. We are not responsible for damage to your console, other hardware, data or accounts caused by installation, use or misuse of our products.
Warranty. Products are covered against manufacturing defects if reported within 30 days of delivery. Once solder has touched a product, it is no longer under warranty of any kind. The warranty also does not cover damage from improper installation, static discharge, physical damage, or use with incompatible hardware.
Legal use. You are responsible for making sure that buying and using our products is legal where you live. Our products are sold for lawful purposes only, such as homebrew, repair, preservation and running software you legally own.
Disclaimer. Except as stated above, products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.
4. Pricing, Payment and Orders
Prices. All prices are in US dollars (USD) and exclude shipping, and exclude import duties and taxes for international orders unless stated otherwise at checkout. We may change prices at any time, but changes do not affect orders already confirmed.
Errors. If a product is listed at an incorrect price or with incorrect information due to an error, we may cancel the order and refund you in full, even after it is confirmed.
Payment. Payment is due in full at checkout through the payment methods shown. By paying, you confirm you are authorized to use that payment method.
Order acceptance. Your order is an offer to buy. We accept it when we ship it or send a shipping confirmation. We may limit quantities or refuse any order.
Cancellations by you. You may cancel an order for a full refund before it ships by contacting us. Once an order has shipped, it cannot be cancelled and Section 7 applies.
5. Shipping and Delivery
Processing and delivery times. We ship from the United States to US and international addresses. Processing and delivery times shown on the Site or at checkout are estimates and are not guaranteed. We are not responsible for carrier or customs delays.
Tracking. When your order ships, we will send tracking information to the email on your order where available.
Lost or stolen packages. Once the carrier marks a package as delivered to the address you provided, we are not responsible for it being lost or stolen. If a package is lost in transit before delivery, contact us and we will work with the carrier on a claim.
5.1 Your Responsibility for a Correct Address
You are responsible for entering a complete and accurate shipping address at checkout, including apartment or unit numbers, postal code and any details the carrier needs. We ship to the address exactly as entered on your order.
- Please check your address before completing your order.
- To change an address, contact us immediately. We can only change it before the order ships.
- If the carrier charges us an address correction or redelivery fee because of an address error, we may charge that fee to you.
- We are not responsible for packages delivered to an incorrect address you provided.
5.2 Packages Returned to Sender Due to Address Errors
If a package is returned to us because the address you provided was incorrect, incomplete or undeliverable, or because you did not collect the package from the carrier, you are not entitled to a full refund. We will contact you, and you may choose one of the following:
- Reship the order. You must pay the new shipping cost in advance before we send the package again.
- Refund. You will receive a refund of the price paid for the products, minus the original shipping cost and any return shipping costs or carrier fees we were charged.
If you do not respond within 30 days of our contact, we will process option 2.
6. International Orders, Import Duties and Taxes
You pay import charges. For orders shipped outside the United States, you are the importer of record. You are responsible for all import duties, taxes (such as VAT or GST), customs clearance, brokerage and handling fees charged by your country or the carrier. These charges are not included in our prices or shipping fees unless we clearly state at checkout that they have been collected.
We cannot predict these charges. Amounts are set by your local customs authority and carrier, not by us. Please check with them before ordering.
Import restrictions. You are responsible for making sure our products can be legally imported into your country. If customs seizes, holds or destroys a package, we are not responsible and no refund is due.
6.1 Refused or Unpaid Import Duties
If you refuse to pay import duties, taxes or fees, or do not pay or collect them in time, the carrier may return the package to us or abandon it.
If the package is returned to us, your refund will be the price paid for the products minus all of the following:
- the original shipping cost;
- the shipping cost we pay to get the package back to us from wherever it is returned from (normally your address or local customs);
- any duties, taxes, storage, return or other fees the carrier or customs charges us.
If these costs equal or exceed the amount you paid, no refund will be due. You may instead ask us to reship the order, if you pay the new shipping cost in advance and agree to pay the import charges.
If the package is abandoned or destroyed by the carrier or customs because the charges were not paid, no refund will be due.
7. Returns, Refunds and Chargebacks
Start with us. To request a return, use our Returns page or email us with your order number before sending anything back. Returns sent without contacting us first may not be accepted.
Defective or incorrect items. If you receive a defective, damaged or incorrect item, contact us within 30 days of delivery with your order number and photos. We will repair, replace or refund the item and cover reasonable return shipping.
Other returns. Unused, unsoldered items in their original condition and packaging may be returned within 14 days of delivery. You pay the return shipping, and the original shipping cost is not refunded.
Items we cannot accept. We do not accept returns of items that have been soldered, installed, modified, damaged after delivery, or returned incomplete.
Refunds. Approved refunds go to your original payment method, usually within 7 business days after we receive and inspect the item. Deductions described in Sections 5.2 and 6.1 apply where relevant. Your bank may take extra time to post the refund.
Chargebacks. Please contact us before filing a chargeback or payment dispute so we can resolve the issue. If you file a dispute for an order that was delivered, or that was returned for the reasons in Sections 5.2 or 6.1, we will provide these Terms, tracking and order records to your payment provider. We may refuse future orders from customers who file disputes in bad faith.
8. Liability, Intellectual Property and Acceptable Use
Limitation of liability. To the fullest extent the law allows, Phenom Mod is not liable for any indirect, incidental, special or consequential damages. This includes damage to consoles or other hardware, lost data, account bans, or lost profits arising from your purchase or use of our products. Our total liability for any claim is limited to the amount you paid for the product involved.
Indemnity. You agree to indemnify and hold Phenom Mod harmless from claims, losses and costs, including reasonable legal fees, arising from your misuse of our products, your breach of these Terms, or your violation of any law or third-party right.
Our content. Text, images, logos, product designs and other content on the Site belong to Phenom Mod or our licensors and collaborators. You may not copy, reproduce or sell them without our written permission.
Third-party trademarks. Xbox, PlayStation and Nintendo, and related names, are trademarks of Microsoft, Sony Interactive Entertainment and Nintendo, respectively. Phenom Mod is not affiliated with, endorsed by or sponsored by these companies. Their names are used only to describe product compatibility.
Acceptable use. You agree not to:
- use our products to pirate games or software, or for any other unlawful purpose;
- place fraudulent orders or use payment methods you are not authorized to use;
- interfere with the Site’s security or operation, or scrape it with automated tools;
- resell our products while claiming to be us or an authorized partner.
9. General Terms and Contact
Privacy. We collect and use your information as described in our Privacy Policy.
Your statutory rights. Nothing in these Terms limits any rights you have under consumer protection laws in your country that cannot be waived by agreement.
Governing law. These Terms are governed by the laws of the State of Pennsylvania, United States, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in the United States, Pennsylvania, unless the law of your country requires otherwise.
Severability. If any part of these Terms is found unenforceable, the rest remains in effect.
Entire agreement. These Terms, with our Returns Policy and Privacy Policy, are the entire agreement between you and Phenom Mod about your use of the Site and your purchases.
Changes. We may update these Terms at any time by posting a new version on the Site. The version in effect when you place an order applies to that order.
